04/23/2004 44 parties, the Court orders that counsel for the parties file the 
04/23/2004 44 following not later than the close of business on May 3, 2004. 1. 
04/23/2004 44 Each side's proposed findings of fact. These shall be presented in 
04/23/2004 44 short, numbered paragraphs and shall be confined to matters of 
04/23/2004 44 subsidiary, rather than ultimate, fact and shall not include matters 
04/23/2004 44 of characterization or argument. All subsidiary facts that the 
04/23/2004 44 proposing side will ask the Court to find shall be included. For 
04/23/2004 44 each statement of fact, reference shall be made to the idenity of the 
04/23/2004 44 witness whose testimony will provide evidence of the fact or 
04/23/2004 44 identification of the proposed exhibit that will be offered in 
04/23/2004 44 support of the fact. 2. Each side's response to the other side's 
04/23/2004 44 proposed findings of fact, consisting solely of the word "disputed" 
04/23/2004 44 or "undisputed", and, if the former, reference to the evidentiary 
04/23/2004 44 basis of the proposed dispute. Such evidentiary basis may be in the 
04/23/2004 44 form of a reference to a witness who is expected to testify to the 
04/23/2004 44 contrary, a proposed exhibit indicating to the contrary, or an 
04/23/2004 44 indication that the party questions whether the proposing side's 
04/23/2004 44 evidence will support the fact. 3. A binder containing copies of 
04/23/2004 44 all exhibits that counsel agree may be admitted at trial. 4. A 
04/23/2004 44 binder containing copies of all exhibits hat either side proposes to 
04/23/2004 44 be admitted at trial to which the other side objects, along witth a 
04/23/2004 44 brief Statment, with respect to each such document, of the ground of 
04/23/2004 44 the obection. 5. Each side's proposed rulings of law, providing 
04/23/2004 44 citations to all authorities that side seeks to have the Court 
04/23/2004 44 consider. Submission of these materials will require consultation and 
04/23/2004 44 cooperation between counsel. The Court expects that counsel will 
04/23/2004 44 confer and reach agreement regarding the sequence and timing of 
04/23/2004 44 exchanges of materials. If ounsel are unable to reach such 
04/23/2004 44 agreement, either may so inform the clerk, and the Court will enter a 
04/23/2004 44 further order. Those facts identified as undisputed by means of the
